Daniel
A. Shmikler has experience in a broad
range of complex commercial litigation, including antitrust, securities,
fraud, defamation, intellectual property, RICO, real estate transactions,
products liability, restrictive covenants, class actions, and contract
disputes. He has represented clients nationwide, at both the trial
and appellate level, in both federal and state courts, as well as
in arbitrations before the American Arbitration Association.
Mr. Shmikler earned his J.D., cum laude, from Northwestern
University, where he was a Note and Comment Editor of the Northwestern
University Law Review. He earned his B.A. in political science
from the University of Chicago. Mr. Shmikler is admitted to practice
in the state of Illinois and in the United States District Courts
for the Northern District of Illinois and the Eastern District of
Michigan.
Recent representative cases:
In re HA-LO Industries, Inc. (Bankr. N.D.
Ill.) (member of team retained as special counsel for debtor to
pursue claims relating to its purchase of Starbelly.com, Inc.);
Morrow v. Roberts (Ill. Cir. Ct.) (member of team representing class
of former shareholders of Talman Bank in pending litigation against
ABN AMRO, LaSalle-Talman Bank, Salomon Brothers, and others for
claims relating to the purchase of Talman and Talman’s claims
against the federal government for abrogation of supervisory goodwill);
DiMucci Home Builders, Inc. v. Metropolitan Life Ins. Co., 728 N.E.2d
749 (Ill. App. Ct. 2000) (counsel to construction company in pending
litigation involving claim for unpaid utility fees; successfully
argued summary judgment issues before Appellate Court of Illinois);
Resource Financial Corp. v. Iwerks Entertainment, Inc. (AAA Arbitration,
Chicago, Illinois) (lead counsel for investment banking firm at
arbitration hearing on its claims for breach of engagement agreement);
E.P. Opportuntity Fund, L.L.C. v. eUniverse, Inc. (AAA Arbitration,
Chicago, Illinois) (represented hedge fund in AAA arbitration involving
claims of securities law violations and breach of a registration
rights agreement); Effikal Int’l, Inc. v. Field Controls,
L.L.C. (E.D. Mich.) (member of trial team defending manufacturer
from claims of trade dress infringement, which obtained judgment
as a matter of law at the close of plaintiff’s case).
